Terms of Business
Welcome to my website. If you continue to browse and use this website, or place an order with me, you are agreeing to comply with and be bound by the following terms and conditions of use.
-
This website is operated by Anna Phillips Music. Throughout the site, the terms “I,” “me", and “my” refer to the business. I supply physical goods, specifically music CDs (4-panel digipacks) and postcards, to consumers within the United Kingdom.
-
All content on this website, including but not limited to; text, photographs, graphics, logos, audio clips, video recordings, and musical arrangements, is the property of Anna Phillips Music and is protected by UK intellectual property laws.
You may view and stream media for your own personal, non-commercial use.
You must not download, copy, distribute, modify, or use any media or content for commercial purposes without prior written consent.
-
UK only: I sell and ship products exclusively to addresses located within the United Kingdom.
Pricing and Description: I make every effort to ensure item descriptions and prices are accurate. In the event of a pricing or stock error, I reserve the right to cancel your order and issue a full refund before dispatch.
Payment: Payments are processed securely via Squarespace's third-party processors.
Order Rejection: Any orders placed with delivery addresses outside of the United Kingdom will be cancelled and refunded in full.
-
Order Acceptance: Your order constitutes an offer to buy. A legally binding contract is only formed when I dispatch your items and send you a shipping confirmation email.
Pricing Errors: I reserve the right to cancel and refund any orders containing pricing errors or inventory inaccuracies before the items are dispatched.
-
Dispatch Schedule: As an independent creator, items are packed and dispatched by hand. I aim to process and dispatch all orders within five business days of receiving your order.
Postal Service: All orders are shipped exclusively within the United Kingdom using Royal Mail 2nd Class. Royal Mail typically takes two to three business days to deliver from the date of dispatch, though this is an estimate and not a guarantee.
Total Estimated Delivery: Please allow up to ten business days from the date of your order for your items to arrive before contacting me regarding a missing delivery.
Risk of Loss: The risk of loss or damage to the goods passes to you once the items are physically delivered to your specified address or left in a designated safe place by Royal Mail.
-
Under the UK Consumer Contracts Regulations, you have the right to cancel your order and return your items for a refund within a "cooling-off" period.
Timeline: You must notify me of your intent to cancel within 14 days of receiving your items. You then have a further 14 days from that notification date to safely return the items to me.
Return Shipping Costs: The customer is solely responsible for the cost of return postage. I do not provide prepaid return labels or reimburse return shipping fees for change-of-mind returns. I highly recommend using a trackable postal service, as I cannot issue a refund for items lost in transit.
Condition of Items & Diminished Value: Because my CD digipacks are supplied unsealed, all items must be returned in pristine, brand-new, and unplayed condition. I inspect all returns. If a CD, digipack, or postcard shows signs of handling beyond what is reasonably allowed in a physical retail shop (such as spine creases, cardboard scuffs, disc scratches, or fingerprints), I reserve the right to reduce your refund by up to 100% to reflect the diminished value of the item.
-
Your Rights: In accordance with the Consumer Rights Act 2015, if an item arrives damaged, faulty, or not as described, you are entitled to a full refund, repair, or replacement.
Reporting Damage: Please contact me within 30 days of delivery with photographic evidence of the damage (e.g., a cracked disc or bent postcard).
Faulty Return Costs: If I require the physical return of a faulty or damaged item, I will cover or reimburse the cost of the return postage.
-
I am not liable for any indirect, incidental, or consequential damages arising from the use of my website or the purchase of my products. My total liability to you for any claim arising out of an order will not exceed the total amount paid by you for that specific order.
-
These terms and conditions are governed by and construed in accordance with the laws of England and Wales and any disputes will be subject to the exclusive jurisdiction of the UK courts.
